These terms govern use of Sherlock Warrants and related Sherlock services, websites, and mobile applications (together, "Sherlock" or "the Service"). The Service is operated by Berner Enterprises, LLC ("be.", "we", "us"), an Arizona limited liability company. By creating an account or using Sherlock, you agree to these terms and to our Privacy Policy at sherlockwarrants.com/privacy. If you use Sherlock in connection with your work for a law enforcement agency, court, or prosecuting office (your "Agency"), you confirm that you are authorized to do so and that your use complies with your Agency's policies.
1. Who may use Sherlock
Sherlock is built for the justice system. Accounts are available to sworn law enforcement officers, courts and their staff, prosecutors, and partners we specifically authorize. It is not intended for the general public and is not directed at anyone under 18. When you create an account you attest to your role, and we verify accounts before granting access. Your account belongs to you alone: credentials may not be shared, and access is limited to legitimate justice purposes. We may suspend or close any account if the attestation was false, if verification fails, or if the account is used outside these terms.
2. Acceptable use
- Use Sherlock only for lawful, authorized justice work.
- Do not share credentials or allow anyone else to use your account.
- Do not attempt to bypass security controls or audit logging, and do not access records outside your authority.
- Do not upload content unrelated to a legitimate case, investigation, or proceeding.
- Do not copy, scrape, resell, or reverse engineer the Service.
3. Your Agency owns its data
Your Agency owns the data it and its personnel put into Sherlock, including warrant content, case information, and uploaded documents ("Agency Data"). That ownership does not change if an officer transfers, separates, or deletes an individual account: Agency Data remains available to the Agency. On request, we will provide an Agency's data to it in a usable format. If you use the Service as an individual and no Agency retention policy applies, your stored documents are deleted with your account. We process Agency Data only to operate the Service, as described in our Privacy Policy, and we do not use Agency Data to train artificial intelligence models. Where an Agency requires it, we execute the FBI Criminal Justice Information Services (CJIS) Security Addendum with that Agency.
4. Augmented intelligence, and what stays yours
Sherlock's assistance features, including Hey Sherlock and the drafting tools, are designed to assist trained justice professionals, not replace them. The drafting assistance is designed to work only from the statement and documents you supply, and assisted content is visibly marked for your review. When you create your account, you acknowledge how this artificial intelligence processing works, as described in our Privacy Policy. Using the assistance features is your choice: nothing you enter is processed by the artificial intelligence unless you use an assistance feature, and the rest of the Service works normally without them. An Agency may direct that assistance features remain off for its personnel.
Three things always remain yours. You supply the facts. You make the legal judgments, including which statutory grounds apply and any special authorizations. You decide whether your probable cause is sufficient. Sherlock does not make those decisions for you, and nothing in the Service is legal advice. Before you sign, swear to, file, or act on any document produced with Sherlock, you are responsible for reviewing it and adopting it as your own work product.
5. Sponsors
Sherlock is available to sworn law enforcement officers at no cost because sponsors fund it. Sponsors receive aggregate impression and click counts only. They never receive your identity, your Agency Data, your queries, or the content of any document. The one exception is yours to make: if you choose to submit a sponsor's contact form, the details you enter on that form are shared with that sponsor so they can respond, and your case information is never included. Sponsor placements do not appear in active drafting workspaces or judicial surfaces.
6. Subscriptions
An optional paid subscription is available, for example to remove sponsor placements. Payment is handled by Apple for purchases in the iOS app, Google Play for purchases in the Android app, and Stripe for purchases on the web, and the applicable store's terms govern billing, renewal, cancellation, and refunds for purchases made through it. You may cancel at any time, effective at the end of the current billing period. Whether or not you subscribe, the privacy and data commitments in these terms and in the Privacy Policy are the same.
7. Availability and disclaimers
We work hard to keep Sherlock available, accurate, and current, but the Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted or error free, or that any output is complete, accurate, or suitable for a particular filing. Where an Agency has a written service agreement with us, that agreement governs uptime and support commitments for that Agency.
8. Limitation of liability
To the maximum extent permitted by law: (a) we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising out of or related to the Service; and (b) our total liability for all claims arising out of or related to the Service will not exceed the greater of one hundred dollars or the amounts paid to us for the Service by you or your Agency in the twelve months before the claim arose. Nothing in these terms limits liability that cannot be limited under applicable law.
9. Suspension and termination
You may close your account at any time from within the app or by contacting us. We may suspend or terminate access for violation of these terms, for a false attestation, at an Agency's direction with respect to its personnel, or where required by law. Termination of an individual account does not affect the Agency's ownership of, or access to, Agency Data. Sections 3, 4, 7, 8, and 10 survive termination.
10. Public records and legal process
Your Agency is responsible for its own records retention, disclosure, and public records obligations. We will reasonably cooperate with an Agency's lawful requests concerning its own Agency Data.
11. Mobile applications
If you use Sherlock through an app downloaded from Apple's App Store or Google Play, these terms are between you and be. only, not with Apple or Google, and their store terms also apply to the download itself. Apple and Google are not responsible for the Service or its content, and have no obligation to furnish maintenance or support for it. You confirm that you are not located in a country subject to a United States government embargo and that you are not on any United States government list of prohibited or restricted parties. Apple and its subsidiaries are third party beneficiaries of these terms with respect to your use of the iOS app, and upon your acceptance of these terms, Apple has the right to enforce them against you as a third party beneficiary.
12. Changes to these terms
We may update these terms as the product evolves. If a change is material, we will give notice through the Service or to Agency administrators before it takes effect. Continued use after the effective date constitutes acceptance.
13. Governing law
These terms are governed by the laws of the State of Arizona, without regard to conflict of laws rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Maricopa County, Arizona, and the parties consent to venue there. Where an Agency has a written agreement with us, that agreement controls over these terms for that Agency. If you use the Service on behalf of a government entity that is prohibited by its own law from accepting this governing law or venue, then to the extent of that prohibition, the law of that entity's jurisdiction governs and venue lies in that jurisdiction.
